Computer Assisted Drawing Files License Agreement
- Acceptance:
- Viewing or utilizing all or part of these Computer Assisted Drawing (CAD) files indicates your acceptance of these terms. If you do not agree to these terms and conditions, please go to the bottom of the page and press the DISAGREE button. This action will terminate your access to the CAD files. The CAD Files are proprietary information of StonePly Co. and are protected under United States and international copyright laws. Title to the CAD Files, or any portion thereof, or any copy thereof, whether modified or merged, shall at all times remain with StonePly Co.
- Permitted Uses:
- The CAD Files, unless used by an Architect or Designer, may be used only for the purpose of developing plans; specifications and/or approval drawings for construction projects utilizing products manufactured or distributed by StonePly Co. If an Architect or Designer, uses the CAD Files, StonePly. shall always be included as an approved manufacturer or vender of products or components to be incorporated into this project.
- Non-permitted Uses:
- Without the express written consent of StonePly Co.. you may not use the CAD Files for any purpose other than the permitted uses described above.
- Term:
- This license is effective from the date you receive the CAD Files, either directly from Stoneply Co. or electronically and shall remain in force until terminated by StonePly. StonePly. may terminate this license at any time for your failure to comply with any of the terms and conditions herein stated. Upon termination of the license you agree to destroy or return to Stoneply the CAD Files together with all copies, modifications or portions of it, in any form and to provide to Stromberg written certification of such destruction or return.
- Warranty:
- Stoneply Co., its employees, suppliers and agents, make NO WARRANTY OR REPRESENTATION regarding the quality, content, form, performance, fitness for purpose, merchantability or otherwise, regarding the CAD Files or other information on this site. You utilize the CAD Files at YOUR OWN RISK and SonePly has and shall have no responsibility for your utilization of the CAD Files.
- Limitation of Liability:
- StonePly Co.has NO LIABILITY, express or implied, to you or any third party arising out of your utilization of the CAD Files for any and all purposes. In the event that it is determined that Stoneply does have any liability, of whatever nature, the liability is LIMITED to compensatory damages of a maximum amount not to exceed $500.00 and there shall be no liability for consequential or punitive damages.
